Terms of Service

Pixel Mask AI (“the Service”) is provided by [FILL IN: full registered company name, e.g. Monotech Systems Private Limited], a company incorporated in India (“Monotech”, “we”, “us”), registered office at [FILL IN: registered office address]. By creating an account or using the Service you agree to these terms. If you are creating an account on behalf of a company or other organization (for example, under a Team plan), you represent that you have the authority to bind that organization to these terms, in which case “you” refers to that organization.

Pixel Mask AI is a subscription web application for print-embellishment mask design (Mask Forge), 3D embellishment preview (Embellishment Preview), and UV/foil cost estimation. It includes an optional AI-assisted element-detection feature that analyzes uploaded artwork to help identify logos, wordmarks, and other elements — this feature calls a third-party AI model server-side; the underlying provider is not otherwise disclosed to end users and is not itself a party to these terms.

You're responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information at signup, including any machine serial number used to activate a hardware-bundled trial. An account is for use by the individual (or, under a Team plan, the specific named individuals) it was created for — don't share login credentials with anyone the account/plan doesn't cover.

Paid plans are billed monthly or yearly in INR via our payment processor. Customers who activate a PixelGlow machine serial number at signup receive 90 days of free access before billing begins; billing starts automatically at the end of that period unless you cancel first. You can cancel anytime from your account page — see our Refund & Cancellation Policy for what happens to a billing period already in progress.

Each plan includes a monthly quota of AI-assisted detection calls. Usage beyond your plan's quota is not billed separately; the feature simply becomes unavailable until your quota resets or you upgrade.

The hardware trial is offered once per PixelGlow machine serial number and is not transferable between machines or accounts. Activating multiple accounts against serials you don't own, or otherwise attempting to obtain more than one trial period per machine, is a breach of these terms and may result in the trial being ended early.

You retain all rights to the artwork, designs, and files you upload. We process them only to provide the Service to you (rendering, tracing, mask generation, AI element detection, and export) — we don't claim ownership of your content and don't use it to train any AI model.

You agree not to:

• upload content you don't have the rights to, or that infringes anyone else's intellectual property;
• attempt to disrupt, overload, scrape, or reverse-engineer the Service, or circumvent your plan's AI quota or any other technical limit;
• copy, modify, or create derivative works of the Service itself (as opposed to the content you create using it), or merge it with another product;
• resell, sublicense, rent, or otherwise provide access to the Service to any third party outside your account/plan's permitted users;
• remove, alter, or obscure any attribution, watermark, or identifying notice the Service places in an export or in the application itself;
• use the Service, including any trial, to build, benchmark, or evaluate a competing product, or provide access to the Service to anyone doing so on behalf of a competing product or business.

Monotech owns the Service, including its software, source code, algorithms, trade secrets, designs, and all associated intellectual property rights. These terms grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose — they do not transfer any ownership of the Service or its underlying technology to you. All techniques and processes embodied in the Service are Monotech's trade secrets; you agree not to attempt to extract, reproduce, or reverse-engineer them except to the extent expressly permitted by applicable law.

We warrant only that the Service will perform substantially as described on this site for the first 30 days after your first payment. If it doesn't, your sole remedy is a refund of that payment or a fix, at our choice — see our Refund & Cancellation Policy.

Beyond that 30-day warranty, the Service — including AI-generated element detections and traced masks — is provided on an “as-is” and “as-available” basis for production assistance — you're responsible for reviewing and approving any mask, trace, or export before sending it to print. Except as expressly stated in these terms, Monotech makes no warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any AI-generated detection or output will be accurate or complete.

Nothing in these terms excludes or limits any right you have as a consumer under applicable Indian law that cannot lawfully be excluded, or excludes our liability for fraud or for death or personal injury caused by our negligence.

To the maximum extent permitted by law, Monotech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service, even if we've been advised of the possibility of such damages — including where a mask, trace, or export produced using the Service leads to a faulty print run or other production loss, which is why we ask you to review and approve output before sending it to print.

Monotech's total aggregate liability arising out of or relating to these terms or the Service, for any cause of action, will not exceed the total fees you paid us for the Service in the 12 months before the event giving rise to the claim.

You may stop using the Service and cancel your subscription at any time from your account page. We may suspend or terminate your access to the Service, with notice by email where practical, if you breach these terms — including the Acceptable Use restrictions in Section 6 — or if we reasonably suspect fraud, abuse, or a security risk. On termination for breach, you're not entitled to a refund of fees already paid, except where required by applicable consumer law or under our Refund & Cancellation Policy.

Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control — including natural disasters, internet or hosting-provider outages, cyberattacks, war, or government action. If such an event prevents Monotech from providing the Service for a continuous period of 30 days or more, either party may terminate the affected subscription by written notice, without further liability.

These terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of [FILL IN: city, e.g. Hyderabad / Chennai].

If any provision of these terms is found unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These terms, together with our Privacy Policy and Refund & Cancellation Policy, are the entire agreement between you and Monotech regarding the Service, and supersede any prior agreement on the same subject. We may update these terms from time to time; material changes will be posted on this page, and your continued use of the Service after a change takes effect constitutes acceptance of the revised terms.
